To claim child maintenance/child support, you should visit your closest maintenance court in your area.

Maintenance Court Procedure

Find out where about is the closest magistrates’ court in your area and pay them a visit. When visiting the Maintenance Court, bring along the necessary documents such as:

  • Birth certificate of your child/children.
  • Your identity document.
  • Proof of residence.
  • A divorce settlement.
  • Proof of your monthly income and expenses.
  • The personal details of the parent required to pay maintenance such as their name, surname physical and work address.
  • Copy of your bank statement.

In attempt to claim maintenance, you will have to fill in a detailed form stipulated by the Magistrate’s Court. This form shall request all details regarding your income and expenses. Lighter expenses such as entertainment and pocket money are also included. Expenses of parents and the child are however, listed separately.

The court however, will take a number of factors into consideration when stipulating the amount of maintenance that should be paid. Both parent’s income will be analysed and the court’s decision will be based accordingly.

    My child father hasn’t been paying for 3 months now and he haven’t gave full amount for June and keep making promises dates after dates he was going to pay the money in as she is 14 years old and a year ago I went to count to increase but still he comes with story’s and never see her not making effort to call or messages unless I say something she did wrong

    how can you assist me please coz taking him to court he say I was going to waste my time

  2. Good day. My child’s father took me to court last year out of nowhere for visitation rights after we haven’t heard from him for months. At court I gave him his full rights, which was my decision for him to have her every second weekend, every second public holiday and half of the school holidays. It was also agreed that he buys toiletries, I will purchase groceries and we will go half on aftercare fees and I will drop her and fetch her at aftercare. He offered to put her on his medical aid, and all of this is on black and white from the court as we both agreed. But now he wants to take her when he feels like, pay when he feels like, then you don’t hear from him, he vanishes and this is causing a lot of inconveniences for me, not only financially. I decided to register her on a medical aid myself and asked him to pay half, only R200. He still hasn’t paid a cent. In the beginning when he didn’t bring his part I left him because I know he had to adjust financially. But I can’t keep being okay with all the inconveniences because his the one that took me to court because he wanted to be in his child’s life.

Hi i hope you can help me last year December 2023 my daughter finished her matric and turned 18 in that month and she is waiting for her matric results and her Farther told he is no longer paying R1000 maintenance from today he will pay again when she go to college.My salary R 4300 is not money.

  6. good day sitting with a big issue my child maintenance being paid through bellville court …garnished from the dad every 25th of each month but then to only receive it the next month by 10th usually but its gone to 20th now how to go about if you call no answer phone just ringing …if you get there which you must borrow money to get to bellville just to be told arrogantly by the ladies working there yes there is money but must still be paid and that they work in batches how a month ….please i need answers

      Yes, you can apply for a maintenance order. The court would advise you on whether you speficially can claim for when you were young.

      We advise you to approach the maintenance court ASAP. Usually, parents must claim, but if you explain your case, they should assist you.

  12. Can a mother increase a maintenance order for 2 children from her ex and demand that he pays more (even if he cannot afford it) if her new husband does not have an income and she has to cover all costs now directly from her salary?

    1. She can ask, but it does not mean one must agree. If she took him to the maintenance court, the court would determine whether her request is fair. If not, they won’t approve it.

My daughter have been going to court two months for child maintenance court and staying out of work and not get paid for that day and every time the father of the child don’t appear, but the last time they found out from the sheriff of the court never handed him the papers. Now how does she found out before she goes to court that he will be there and don’t go for nothing and waste a day in court?

      The way forward is to approach the maintenance court in your area. The Court would call you both in and make a fair decision as to what she must pay.
