Constitutional Court ruled that it is unconstitutional for a husband not to be able to have his wife’s surname – 11 September 2025

The Constitutional Court has ruled on 11 September 2025 that sections 28(1)(a) to (c) of the Births and Deaths Registration Act are unconstitutional, ordering that they be changed to allow men to take the surnames of their wives in marriage. They have twenty-four months.
